Terms of Service

By creating an account or using any MUXTI mobile application (iOS or Android) or the MUXTI website and web application (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

MUXTI ("we", "us", "our") is operated by Boogie Apps, based in Nicosia, Cyprus. These Terms are governed by the laws of the Republic of Cyprus.

MUXTI provides the technology and advertising marketplace only. MUXTI is not the seller, buyer, landlord, tenant, estate agent, broker, dealer, service provider, or representative of any user, unless explicitly stated otherwise in relation to a specific MUXTI-operated service. Users who advertise goods, property, or services on the Platform are solely responsible for those advertisements. Contracts and agreements concerning advertised goods, property, or services are concluded directly between the relevant users. MUXTI does not become a party to any underlying transaction or agreement merely because users discovered one another, communicated, or used functionality through the Platform.

You must be at least 18 years old to use the Platform. By using MUXTI you confirm that you are 18 or older and have the legal capacity to enter into binding agreements.

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current and complete information when registering.
• You may not create accounts for others or allow others to use your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Private User means a natural person using MUXTI predominantly for purposes outside their trade, business, craft or profession.

Professional User (or Trader) means a natural or legal person acting for purposes relating to their trade, business, craft or profession, including persons acting in their name or on their behalf.

Professional Users must:

• accurately identify their commercial status on MUXTI and not represent commercial activity as private activity;
• provide accurate, complete and current business information, including legal name, trading name, contact details and applicable registration or licence numbers;
• promptly update any information that becomes inaccurate, incomplete or expires;
• maintain all licences, registrations, permits and authorisations legally required for their activities and profession;
• comply with all applicable laws governing their business or profession, including consumer protection, advertising, data protection and sector-specific regulations;
• provide supporting documentation when requested by MUXTI to substantiate their professional status or credentials.

MUXTI may restrict or suspend professional listing privileges where required information has not been provided, cannot reasonably be verified, or where the Professional User is found to have misrepresented their status or credentials. Professional classification by MUXTI is an administrative designation only and does not relieve the Professional User of any legal obligation.

MUXTI may display a professional or business badge or indicator on listings and profiles of verified Professional Users.

MUXTI may offer verification services that allow users to submit documentation or information for review. Verification badges displayed on a profile indicate only that MUXTI has reviewed the specific information described in the badge at the time of verification. Verification does not constitute an endorsement, guarantee, or representation by MUXTI regarding:

• the accuracy, completeness or currency of any individual listing;
• the professional competence, financial standing or trustworthiness of the user;
• the quality, safety or legality of any goods or services offered; or
• the user's conduct in any transaction.

Verification statuses may expire or be revoked if submitted documentation expires, is found to be inaccurate, or if MUXTI determines the account no longer meets the relevant criteria. MUXTI reserves the right to modify, suspend or remove any verification badge at any time without prior notice.

Users must not misrepresent their verification status. Submitting false, forged or misleading documentation in connection with a verification request constitutes a serious breach of these Terms and may result in immediate account suspension.

MUXTI classifies user accounts as either Private or Professional in order to provide transparency to other users about the capacity in which an advertiser is acting. Professional accounts may be further sub-classified by business type (for example, Licensed Real Estate Agent, Motor Dealer, Retailer / Merchant, or Professional Service Provider) based on the information submitted during registration or profile setup.

Accurate disclosure is required. Users must accurately represent their status when creating or updating their account. You must not register as a private individual if you are, in fact, operating in a commercial or professional capacity, and you must not represent commercial activity as private selling. Indicators of commercial activity include, but are not limited to: listing goods or services in trade, advertising multiple similar items, offering goods that are new or sourced wholesale, or using language that indicates business operations.

MUXTI's right to classify and reclassify. MUXTI reserves the right to review account activity and, where we reasonably determine that an account classified as Private is operating commercially, to request that the account be reclassified as Professional before the relevant advertising activity may continue. We may notify you of this determination via the Platform. You will have the opportunity to update your account settings or dispute the classification. Accounts that do not comply with a reclassification request may have listings suspended or removed.

Classification is not a legal determination.MUXTI's classification of an account as Private or Professional is based solely on the information available to us through the Platform. It does not constitute a legal determination of your status as a "trader", "consumer", or otherwise under applicable law, including any consumer protection or distance selling regulations in the Republic of Cyprus or the European Union. You are solely responsible for understanding and complying with your own legal obligations.

MUXTI makes no representation that the classification displayed on any account is accurate, complete or up to date, and accepts no liability arising from reliance on advertiser classification by any user.

MUXTI is an online marketplace and advertising platform that enables private individuals and professional users to advertise, discover, buy, sell, rent, exchange and offer eligible goods, property and services within Cyprus. When you post a listing you represent and warrant that:

• You own or have the legal right to advertise the item, property, or service.
• All information in the listing is accurate and not misleading.
• The item is legal to sell in the Republic of Cyprus.
• The listing does not infringe any third-party intellectual property rights.

The following items are strictly prohibited on MUXTI:

• Tobacco products, cigarettes, electronic cigarettes (vapes), e-liquids, and related smoking accessories
• Alcohol and alcoholic beverages
• Illegal drugs, controlled substances, and drug paraphernalia
• Prescription or non-prescription medicinal products
• Firearms, ammunition, and weapons of any kind (including knives and bladed articles)
• Fireworks and pyrotechnics
• Counterfeit, pirated, or stolen goods
• Adult or sexually explicit content
• Endangered or protected wildlife, animal parts, or CITES-listed species products
• Hazardous substances, illegal gases, or dangerous chemicals
• Food, drinks, and dietary supplements
• Personal hygiene devices
• Currency (except for numismatic/collector purposes), gift cards, vouchers, or tickets
• Online game accounts or digital platform items
• Any item whose sale is prohibited under the laws of the Republic of Cyprus

MUXTI reserves the right to remove any listing that violates these terms without notice, and to apply strikes or suspend accounts where violations occur.

Where the Platform makes a property or real estate category available, users may only advertise a property when legally entitled or authorised to do so. Permitted advertiser categories include:

• Property owner
• Licensed real estate agent or agency (ETEK-registered or equivalent)
• Property developer
• Authorised representative of the owner (e.g. under power of attorney)
• Any other person or entity legally entitled to advertise the property under Cyprus law

By publishing a property listing you represent and warrant that you possess all rights, permissions, licences, consents and authority required to advertise the property. MUXTI reserves the right to request supporting evidence (including but not limited to title deeds, power of attorney, agency licence, or company registration) and to reject, suspend or remove any property listing where satisfactory evidence is not provided.

MUXTI is not a licensed estate agent, broker, or property management company. Listing a property through MUXTI does not create any agency, brokerage, or representation relationship between MUXTI and any user.

All information published in property listings on the Platform is provided solely by the advertising user. MUXTI does not independently verify, audit, or warrant any information contained in property listings. To the maximum extent permitted by applicable law, MUXTI makes no representation or warranty, express or implied, as to:

Property particulars

Including but not limited to: legal ownership; title; availability; property boundaries; location accuracy; measurements or advertised area; planning permission status; building permits; zoning classification; physical condition; structural condition; advertised price; valuation; photographs or visual representations; energy-performance information; tenancy status; development status; or completion status.

Encumbrances and restrictions

Whether the property is free from mortgages, charges, liens, memos, encumbrances, court orders, third-party rights, tenancies, planning restrictions, building irregularities, or other legal or financial restrictions of any nature.

Property information is supplied solely by the advertising user and remains their responsibility. Prospective buyers and tenants must conduct their own independent due diligence and verification of all material information before making any offer, reservation, payment of a deposit, or entering into any agreement in connection with a property.

Users are strongly advised to obtain appropriate independent professional advice before proceeding, including (as relevant to their circumstances) legal advice, conveyancing, financial advice, mortgage advice, property valuation, structural surveying, engineering surveys, and/or planning consultancy.

MUXTI does not provide real estate brokerage or agency services, legal advice, conveyancing services, property valuation, structural surveying, or financial advice of any kind.

Viewings, negotiations, reservations, deposits, lease agreements, purchase contracts, and all related arrangements take place exclusively between users and/or their appointed professional representatives. To the maximum extent permitted by applicable law, MUXTI is not a party to those arrangements and accepts no responsibility or liability in connection with them, unless a particular MUXTI service expressly and specifically states otherwise.

Where a rental listing constitutes short-term or self-catering accommodation as defined under Cyprus Tourism Law (including Law N.34(I)/2019 and its amendments and any successor legislation), the advertising user is solely responsible for ensuring that their property is registered with the Deputy Ministry of Tourism of the Republic of Cyprus and that a valid registration number is in force for the duration of the advertisement.

When listing a property for short-term or self-catering rental, users must:

• Indicate that the listing constitutes short-term / self-catering accommodation in the relevant listing field.
• Provide their valid Deputy Ministry of Tourism Registration Number. This field is mandatory and the listing cannot be published without it.
• Ensure the registration number provided is accurate, current, and has not expired at the time of publication or renewal of the listing.
• Update or remove the listing immediately if their tourism registration expires, is suspended, or is revoked.

MUXTI does not verify the validity of tourism registration numbers provided by users. The provision of an inaccurate, expired, suspended, or revoked registration number constitutes a material breach of these Terms and may result in immediate removal of the listing and suspension or termination of the account. MUXTI reserves the right to flag, suspend, or remove any short-term rental listing where there are reasonable grounds to question the validity of the tourism registration.

Users are solely responsible for complying with all applicable Cyprus laws, regulations, and local authority requirements governing short-term and self-catering accommodation, including but not limited to tourism licensing, health and safety requirements, tax obligations (VAT and tourist levy where applicable), and any conditions attached to their tourism registration. MUXTI accepts no responsibility or liability in connection with any user's failure to comply with such requirements.

MUXTI has a zero tolerance policy for objectionable content and abusive behaviour. Violations result in immediate removal of the offending content and permanent suspension of the account without refund. Specifically prohibited:

• Harassment, threats, or abuse of any user.
• Hate speech or discriminatory content based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Sexual content involving minors (will be reported to relevant authorities).
• Fraudulent listings or scam attempts.
• Spam or unsolicited commercial messages.

You can report content or users you believe violate these standards using the Report function available on every listing and profile. We review all reports and take appropriate action.

Payments on MUXTI are processed by Stripe, Inc. By making or receiving payments you also agree to Stripe's Services Agreement. MUXTI does not store your payment card details.

All transactions and agreements are between the relevant parties (buyers, sellers, landlords, tenants, and service providers). MUXTI is not a party to any transaction or agreement and accepts no liability for disputes between users regarding goods, property, services, condition, or delivery.

Posting listings is free. Optional paid features such as listing boosts are charged at the rates displayed in the app at the time of purchase. All fees are displayed inclusive of VAT where applicable under Cyprus law. Fees for consumed boosts are non-refundable.

By posting content on MUXTI you grant us a non-exclusive, royalty-free, worldwide licence to display and distribute that content for the purpose of operating the Platform. You retain ownership of your content. We do not claim ownership of user content.

The MUXTI name, logo, and Platform design are the property of Boogie Apps and may not be used without prior written permission.

The Platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy of listings, the identity of users, or the completion of any transaction. Use of the Platform is at your own risk.

To the maximum extent permitted by Cyprus law, MUXTI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including loss of profits, data, or goodwill.

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time from the Settings screen in the app.

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.
